Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records from the file of the 2nd respondent relating to his order dated 17.09.2009 by the issue of the Court order or directions and to quash the same.

O R D E R

The final warrant notice issued by the Assistant Revenue Officer, Chennai Corporation in proceedings dated 17.09.2009 is under challenge in this writ petition.

2.The learned counsel appearing on behalf of the writ petitioner states that enhanced assessment of property tax was made in the year 1998-1999 and the property tax was enhanced to Rs.9,631/-(Rupees Nine Thousand, Six Hundred and Thirty One only). However, the petitioner had paid the arrears of property tax amount and subsequently, the revised tax also had been cleared by the writ petitioner.

3.The learned counsel for the respondents states that the arrears of property tax to be paid as of now in respect of the premises belongs to the writ petitioner is Rs.20,351/-(Rupees Twenty Thousand, Three Hundred and Fifty One only). Thus, the petitioner has to pay the balance amount, so as to clear the entire property tax arrears amount.

4.In this view of the matter, the petitioner is directed to pay the entire property tax arrears amount of Rs.20,351/-(Rupees Twenty Thousand, Three Hundred and Fifty One only) within a period of four weeks from the date of receipt of a copy of this order.

5.Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
