ORDER
This Criminal Original Petition has been filed to modify the condition in Para No.5(1), in order dated 18.05.2026 in Crl.MP.No.102 of 2026 on the file of the learned District Munsif Cum Judicial Magistrate Court, Uthukottai.
2. The petitioner is the owner of Ashok Leyland Goods Carrier Vehicle, which was seized by the respondent Police. The petitioner filed return of property petition in Crl.MP.No.102 of 2026. The Trial Court by order dated 18.05.2026 granted interim custody of the vehicle with certain conditions and one of the condition is that the petitioner shall execute a bond of Rs.5,00,000/- along with two sureties and both the sureties should be a permanent resident within the jurisdiction of Tiruvallur, amongst which one shall be the blood surety.
3. The contention of the petitioner is that the said vehicle itself is valued only Rs.3,00,000/-. However the Lower Court, while ordering interim custody, has imposed a condition direction the petitioner to execute a bond for a sum of Rs.5,00,000/-, which is onerous. Hence he is unable to furnish the requisite surety.
4. The learned counsel for the petitioner submitted that the petitioner is ready and willing to execute a bond for a sum of Rs.25,000/- as condition for interim custody of the said vehicle.

Considering the above submissions, this Court modifies condition No.5(1) in Crl.MP.No.102 of 2026 on the District Munsif Cum Judicial Magistrate Court, Uthukottai to the following extent: "The petitioner shall execute a bond of Rs.25,000/- (Rupees twenty five thousand only) along with two sureties. Both the sureties should be a permanent resident within the jurisdiction of Tiruvallur District. Amongst which one shall be the blood surety for the above sum."
6. The other conditions imposed in the order 18.05.2026 in Crl.MP.No.102 of 2026 on the file of the District Munsif Cum Judicial Magistrate Court, Uthukottai, remain unaltered. Accordingly, this Criminal Original Petition is disposed of.
