IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 30.07.2019
CORAM
THE HONOURABLE MR.JUSTICE T.RAJA Tr.C.M.P.No.570 of 2019 A.Rajaram ...
Petitioner -vsTamil Ilakkiya @ Jayapriya D/o Panchacharam ...
Respondent Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure to withdraw the I.D.O.P.No.15 of 2019 on the file of the Principal District and Sessions Court, Vellore and transfer the same to the Principal Family Court, Chennai.
For Petitioner ::
Mr.P.Krishnan
ORDER
Mr.A.Rajaram, husband of the respondent, has wrongly come to this Court with the prayer for withdrawal of the pending I.D.O.P.No.15 of 2019 from the file of the Principal District and Sessions Court, Vellore and transfer the same to the Principal Family Court, Chennai, without knowing that even five year old matters are all pending in all the Family Courts in Chennai. Secondly, it is the claim of the learned counsel for the petitioner that both the petitioner and the respondent are working in Arakkonam and since there is no sufficient transport facility available to reach Vellore from Arakkonam, he has been advised to come to this Court.
2. The statement made by the learned counsel for the petitioner is highly unbelievable. From Arakkonam to Vellore, there are number of Government as well as private buses. Secondly, for the simple reason that there are express trains passing through Arakkonam to Chennai, the petitioner cannot come https://hcservices.ecourts.gov.in/hcservices/
to this Court seeking for transfer of the case. Hence, the transfer civil miscellaneous petition stands dismissed. Consequently, C.M.P.No.16114 of 2019 is also dismissed. Sd/- Assistant Registrar(CS VIII) //True Copy// Sub Assistant Registrar ss To
