Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus to direct the respondents to consider the representation letter dated on 16.09.2024 in relation to pay the due salary amount for a period 19 months which is a total of Rs.2,85,000/- along with an interest rate of 18% per annum to me within the time fixed by this Court. ORDER

The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the respondents to consider the representation letter dated on 16.09.2024 claiming to pay the salary arrear amount for a period of 19 months, which comes around Rs.2,85,000/- along with interest at the rate of 18% per annum within a reasonable time to the petitioner.

The learned counsel appearing for the petitioner would submit that for a period of 19 months, the respondents have not paid salary to the petitioner and that the salary amount due comes around Rs.2,85,000/-. Claiming such salary amount, the petitioner has sent a representation on 16.09.2024 and such representation is yet to be considered by the respondents.

However, the learned Special Government Pleader appearing on behalf of the respondents would submit that as and when the respondents receives the amount from the Government, they would settle the entire salary arrear amounts due, to the petitioner. Further, the learned Special Government Pleader on written instructions from the Block Development Officer would fairly submit that the salary was paid to the petitioner finally, only during 2/5

March 2023 and thereafter, no salary was paid as they did not receive amounts from the Tancem Company.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above fair submission made by the learned Standing Counsel, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to pay the salary arrears amount to the petitioner from April 2023 to till date, within a period of two (2) months from the date of receipt of a copy of this order.

6. With the above observations, this Writ Petition is disposed of. No costs.
