ORDER
This Writ Petition has been filed for direction directing the respondents herein to disburse the family pension on account of the death of my husband Viz.Breakan (Fountain Cleaner) based on representation dated 28.05.2024 within a stipulated time as fixed by this Hon'ble Court.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner's husband was appointed as Fountain Cleaner in the third respondent on 03.04.2000 and his service was regularized on 04.04.2001. Thereafter, he died on 24.03.2021. After his demise, his earned leave benefits were disbursed to the petitioner. However, the request made by the petitioner for family pension was not considered.
4. On instructions, the learned Special Government Pleader appearing for the respondents submitted that the petitioner's husband has been now included in the eligible list and the claim of the petitioner can be considered.
5. In view of the above submissions, the first respondent is directed to
consider the claim made by the petitioner seeking family pension on the demise of her husband and disburse the arrears of family pension and continue to pay family pension to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
6. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
