ORDER

This Criminal Original Petition is filed to quash the First Information Report in Crime No.363 of 2021 on the file of the respondent police.

2. The gravamen of the allegations contained in the First Information Report is that the de facto complainant noticed that an Uninterruptible Power

Supply (UPS) was missing from the office. Thereafter, an enquiry was conducted with the petitioner and two other employees, during which they allegedly admitted to the same. On further verification, it was found that several other items were also missing from the office. Hence, the present case came to be registered.

3. The petitioner seeks to quash the First Information Report on the ground that he is innocent and has been falsely implicated in the case. Such factual defences are matters to be placed before the Investigating Officer during the course of investigation and, if necessary, before the trial Court during the trial. The First Information Report cannot be quashed merely on the basis of such disputed questions of fact. Therefore, while leaving it open to the petitioner to place all the relevant materials before the Investigating Officer, this Court is not inclined to entertain the prayer for quashing the First Information Report.

4. Accordingly, this Criminal Original Petition stands disposed of. Consequently, the connected miscellaneous petition is closed. 30-06-2026 skr
