Respondents Prayer : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records on the file of the 2nd respondent made in O.Mu.No.3349/A3/2021, dated -9-2020, signed on 21.9.2021 and quash the same and direct the 3rd 1/4

respondent to resubmit the proposal for increment to the second respondent and consequently direct the 2nd respondent to sanction the Annual Increments as and when it becomes due to the petitioner without reference to Audit objection (for not completing the Child Psychology training).

ORDER

The petitioner seeks permission of this Court to withdraw this writ petition on the ground that the petitioner's V.R.S. (Voluntary Retirement from Service) application has not been accepted due to the pendency of this writ petition. The petitioner has challenged the impugned recovery order in this writ petition. The petitioner has also sought for liberty to file a fresh writ petition, once his V.R.S. is accepted by the respondents and in case, his grievance with regard to the impugned recovery order is not redressed by the respondents.

2. No prejudice would be caused to any of the parties, if such a direction is issued.

3. Accordingly, this writ petition is dismissed as withdrawn. However, liberty as sought for by the petitioner is granted. No costs.
