Respondents PRAYER:- Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Mandamus directing the first and second respondents to pay the interest at the rate of 18% per annum for the belated payment of the gratuity of Rs.10,11,150/- along with computation to a tune of Rs.8,83,676/- and leave salary to a tune of Rs.4,95,584/- along with the future interest payable from the date of payment made till the date of realization.

ORDER

Mr.G.Saravana Kumar, learned Standing Counsel takes notice on behalf of the respondents.

2. It is the case of the petitioner that the petitioner has retired as early as 30.06.2018 but the DCRG and other terminal benefits were paid belatedly to the petitioner. Therefore, this Writ Petition has been filed for interest on the belated payment of DCRG and other terminal benefits at the rate of 18% per annum.

3. Already several orders have been by this Court wherein, this Court had directed the respondents to pay interest on the belated payment of DCRG at the statutory rate of interest and on the other amounts at the rate of 4% per annum. Considering the same, this Writ Petition is disposed by directing the respondents to pay statutory rate of interest on the belated payment of DCRG within a period of eight weeks from the date of receipt of a copy of this order.

4. As far as the belated payment of interest on the other amounts are concerned, it is ordered as follows:- The respondents are directed to consider the representation dated 14.02.2020 of the petitioner and to pay interest at the rate of 4% per annum for the belated payment of Gratuity, Computation, Leave Salary and other legal dues to the petitioner in six equated monthly instalments commencing from 1st December, 2021. No costs.
