O R D E R

The petitioner herein challenges the order passed by 3rd respondent refusing the request of the petitioner for grant of patta for her land in S.No.159/1 situated in Vandranthangal Village, Katpadi Taluk, Vellore District.

According to the petitioner, she has been in possession and enjoyment of the above said land by doing agricultural work for the past 15 years and based on her long possession, she approached the 3rd respondent seeking issuance of patta. The 3rd respondent negatived the claim of the petitioner on the ground that subject land is classified as 'Kallankuthu' in the revenue records and hence, her request for issuance of patta cannot be considered. Aggrieved by the same, the petitioner is before this Court.

3. The learned Additional Government Pleader appearing for the respondents produced the copy of Village A-Register before this Court. 2/4

4. A perusal of the same would establish the land in question is classified as 'Government Unassessed Waste Land' (muR jPu;it Vw;glhj jupR) in the A-Register. In Column No.12, it is also mentioned as 'Kallankuthu'. Therefore, it is clear the land is Unassessed Rocky Land not fit for any cultivation. In these circumstances, the 3rd respondent has rejected the request of the petitioner for issue of patta. If the petitioner is landless poor, it is always open to her to approach the 1st respondent seeking assignment of the land fit for agricultural operates subject to the petitioner satisfy the eligibility criteria.

5. With this observation, the Writ Petition stands dismissed. No costs. Consequently, the connected writ miscellaneous petition is closed. 13.08.2024 Index : Yes/No Speaking order:Yes/No dm 3/4
