O R D E R

The present Criminal Original Petition has been filed seeking to quash the proceedings pending against the petitioner in Spl.S.C.No.17 of 2020 on the file of the Principal Sessions Court, Salem. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that the trial in this case has already commenced and that 12 witnesses out of 52 witnesses have been examined.

Taking note of the facts of the case and the submissions made by the learned Government Advocate (Criminal Side) that the trial has already commenced in this matter, this Court is not inclined to interfere with the trial proceedings at this stage.

At this juncture, the learned counsel appearing for the petitioner submitted that the petitioner is a lady aged about 73 years and that none of the witnesses has spoken about her during their evidence. Therefore, he sought the indulgence of this Court, to dispense with the personal appearance of the petitioner before the trial Court. 2/4

Given the stage of the case which is sought to be quashed, the Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petitions are closed. However, finding justification in the plea of the learned counsel for the petitioner qua the petitioner's personal appearance, the personal appearance of the petitioner before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. The petitioner shall be duly represented by her counsel before the trial Court on all hearing dates. 25.02.2026 ham To 1.
