ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 7, 8, 9(m), 9(f) and Section 10 of POCSO Act 2012 in Crime No.5 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The prosecution is that the petitioner, a cook at Undu Uraidida Palli school in Salem District, allegedly misbehaved with and threatened four 5 th standard students while they were playing. The incident was later reported to the Child Welfare Committee, which conducted an enquiry and referred the matter to the police, resulting in the registration of a case against the petitioner. 3.Learned counsel for the petitioner submits that the petitioner has nothing to do with the alleged offence and he has been falsely implicated in this case. He submits that the Head Master not come to the school regularly and the petitioner only taking care of the school. As such the petitioner questioned the Head Master and the Head Master instigated and tutored the children and the

respondent police foisted the false case against the petitioner. Hence, he prayed for anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit that the petitioner misbehaved and threatened with the victims, who are minor girls studying 5 th standard. Hence, opposed for grant of anticipatory bail to the petitioner.

5.Taking into consideration the gravity of the offence and the victim girls is only 10 years old and the petitioner misbehaved and threatened with the school going children, this Court is not inclined to grant bail to the petitioner and hence, this petition stands dismissed.
