Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Certiforarified Mandamus, calling for the records of the impugned transfer order in Na.Ka.No 852 / 2024 / Q2 dated 04.07.2024 on the file of 2nd respondent and the consequential order of discharge in Na.Ka. 411 / 2024 / A3 dated 10.07.2024 on the file of 3rd respondent and quash the same and directing the respondent 2 and 3 to permit the petitioner to continue her service in the 4th respondent school. ORDER
This Writ Petition has been filed challenging the order of transfer passed by the second respondent dated 04.07.2024 and consequential discharge order dated 10.07.2024 on the file of the third respondent.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner was originally appointed to the post of
Noon Meal Organizer in the Kottur Panchayat Union Primary School, Kumaran Kattam, Aanaimalai Block, Coimbatore District, on 09.12.1992. Thereafter, the petitioner was transferred to the fourth respondent School on 01.04.2015 as Noon Meal Organizer. Now, the petitioner has been transferred from the fourth respondent School to the fifth respondent School. The distance between the fourth respondent School and the fifth respondent school is 100 meters. The only contention raised by the petitioner is that the petitioner is elected as President of the Union and as such in order to wreck vengeance, the petitioner is now transferred from the fourth respondent School to the fifth respondent School.
4. The fifth respondent School is a Government Aided School and the salary and benefits are paid by the Government. That apart, the distance between the fourth respondent School and the fifth respondent School is only 100 meters. The petitioner was already relieved from the fourth respondent School by an order dated 10.07.2024 and the other person, who is transferred in the place of the petitioner, has also joined in the fourth respondent School.
5. In view of the above, this Court finds no infirmity or
illegality in the order passed by the second respondent. Thus, the writ petition itself is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed.
