COMMON ORDER On the complaint lodged by the 2nd respondent Vasudevan, the 1st respondent police has registered a case in Crime No.25 of 2016 for offences under Sections 420 and 506(i) of IPC against

(1) Esthar Anitha [A1], (2) Kamaraj [A2], (3) Johnbrito [A3],

(4) Antonykoba [A4] and (5) Jenifer [A5] challenging which the petitioners are before this court with these criminal original petitions.

2. On a reading of the FIR, it is alleged by the de facto complainant that A1 Esthar Anitha is running a firm in the name of "Adam Trust Alpha Educations" and she promised to get medical college admission for the de facto complainant's son in Saint Petersburg Medico Social Institute in Russia. Believing her representation, the de facto complainant had paid Rs.5,50,000/- and his son was sent to Russia where to their shock and surprise, they found that the said medical college is only a Tution Center and not a recognized university.

3. The learned counsel for the petitioners submitted that Adam Trust Alpha Educations has been run only by Esthar Anitha [A1] and her other family members have nothing to do with the affairs of the said educational institution and that they have been falsely roped in by the prosecution.

4. The learned Additional Public Prosecutor submitted that the allegations are serious and it would be too premature to quash the FIR.

5. Taking into consideration the facts and circumstances of this case, this court directs the Assistant Commissioner of Police, CCB, Coimbatore, to investigate the case thoroughly and if it is found that the petitioners herein have been falsely implicated, it is needless to state that further action against them shall be dropped.

6. In the result, both the criminal original petitions are closed with the above observations. Consequently connected MPs are closed.
