A.No.3800 of 2024 A.No.3800 of 2024 Krishnan Ramasamy, J., This application has been filed to extend the mandate of Arbitral Tribunal for a further period of 6 months.
2. The learned counsel for the applicant seeks for extension of mandate of the learned Arbitrator, inasmuch as the mandate is going to expire on 10.08.2024. The learned counsel also drawn the attention of this Court to the Minutes of 22nd Sitting held on 04.07.2024, (annexed at Page No.21 in the Typed Set of Papers) wherein, the learned Arbitrator recorded that both the parties have agreed to approach the Court for an extension of mandate of the learned Arbitrator. Therefore, the learned counsel prayed for extension of the mandate.

However, today i.e., 29.07.2024, when this matter was taken up at the fore noon session, there was no representation on behalf of the respondent, hence, this Court asked the learned counsel for the petitioner to contact the learned counsel for the respondent and inform him about the hearing of the case and the matter was passed over. A.No.3800 of 2024 Krishnan Ramasamy, J., jd respondent would submit that, he has no objection for extension of mandate of the learned Arbitrator.

Considering the submission made by the learned counsel for the petitioner and in view of the fact that both the learned counsel have agreed before the learned Arbitrator for extension of mandate of the Arbitrator, which was, in fact, recorded by the learned Arbitrator, during the arbitral proceedings held on 04.07.2024, (referred to supra), this Court is inclined to extend the mandate, however, not a period of six months as sought for by the applicant, but only for a period of four months.
5. Accordingly, the Application is disposed of. Consequently, the mandate of the learned Arbitrator to pass an Award is extended by a period of four months from the date of receipt of a certified copy of this order by the learned Arbitrator from the Registry.
