ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to process the application submitted by the petitioner for issuance of passport. 2.

Heard Mr.P.Muthamizhselvakumar, learned counsel for the petitioner and Mrs.A.Anuradha, learned Central Government Standing Counsel for 1st respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate [Crl. Side] for 2nd respondent. 3.

The learned Government Advocate appearing on behalf of the 2nd respondent submitted that there were two previous cases against the petitioner. The 1st case is in Crime No.127 of 2022 for offence under Section 143 and 341 of IPC and in this case, the investigation has been completed and the police report has been filed before the Judicial Magistrate, Thiruthuraipoondi and the same is yet to be taken on file. The 2nd case is in Crime No.132 of 2018 which

ultimately ended in a closure report as further action dropped. 4.

In the considered view of this Court, the mere registration of an FIR which is yet to translate itself into a police report, cannot be a ground for the 1st respondent to deny the issuance of passport to the petitioner. There is no "case pending" against the petitioner. Hence, there shall be a direction to the 1st respondent to process the application submitted by the petitioner and to issue the passport, if the petitioner has satisfied all the other requirements. This process shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs.
