O R D E R

This writ petition has been filed for a direction to the 3rd respondent to consider petitioner's on-line application dated 13.03.2024 for sub-division and issue of separate patta in his favour for the property in T.S. No.498 situated at Kamarajar Nagar, Block No.19, Ward No.1, Thiruppathur Municipal Town, Thiruppathur Taluk & District for an extent of 246 sq.mtr. out of 492 sq.mtr.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the entire materials available on record.

3. It is the case of the petitioner that he has inherited his father's property of an extent of 123 sq.mtr. On 30.10.2023, he has purchased another extent of Page 2/5

123 sq.mtr. from one Sundarababu and Jayakumar by way of a sale deed. He was in possession and enjoyment of total extent of 246 sq.mtr. of property. The third respondent has also issued certificate stating that 246 sq.mtr. out 492 sq.mtr. of the property petitioner is in possession. Therefore, on 13.03.2024, he has applied for sub division and separate patta through on-line. As the respondents have not taken any action, the petitioner has filed this writ petition for a direction to the respondents to consider his application.

Considering the limited relief sought for in this writ petition, the third respondent is directed to consider the application of the petitioner dated 13.03.2024 and pass appropriate orders on the petitioner's application for subdivision and issuance of separate patta for the land situated in T.S. No.498 situated at Kamarajar Nagar, Block No.19, Ward No.1, Thiruppathur Municipal Town, Thiruppathur Taluk & District for an extent of 246 sq.mtr. out of 492 sq.mtr., on merits and in accordance with law, after giving notice to the neighbouring land owners and any other interested persons. Such exercise shall be completed within a period of two months from the date of receipt of copy of this order.

5. With the above direction, the writ petition is disposed of.
