Prayer : Transfer civil miscellaneous petition filed under Section 24 of CPC, seeking to withdraw IDOP.No.908 of 2021 pending on the file of the Family Court, Madurai and transfer the same to the file of the Family Court, Chennai. For Petitioner :

O R D E R

The petitioner / wife seeks transfer of IDOP.No.908 of 2021 on the file of the Family Court, Madurai to the Family Court, Chennai. Transfer is sought for mainly on the ground of convenience, since the wife is a resident of Kolathur near Chennai. The husband is admittedly, a resident of Madurai. 2.Heard Mrs.Sudha Ramalingam, learned counsel appearing for the petitioner and Mr.G.Kannan, learned counsel appearing for the respondent.

3.Mr.G.Kannan, learned counsel appearing for the respondent / husband would submit that the respondent / husband is ready to co-operate and conduct the case before the Family Court at Chennai but, would seek an early disposal. 4.Considering the fact that the Family Court, Chennai is over crowded, I am of the opinion that this matter could be transferred to the Principal District Court, Tiruvallur, which will be nearer to the residence of the petitioner than the other near by District Courts.

5.In view of the above, IDOP.No.908 of 2021 is withdrawn from the file of the Family Court, Madurai and transferred to the Principal District Court, Tiruvallur to be tried and disposed of in accordance with law. The Principal District Court, Tiruvallur is required to dispose of IDOP.No.908 of 2021 within a period of one year from the date receipt of the records from the transferor Court.

6.This transfer civil miscellaneous petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
