The petitioner, who was arrested and remanded to judicial custody on 23.01.2025 for the offence punishable under Sections 65(2) of BNS, Section 5(m) and 5(1), 4(2) of POCSO Act, 2012 in Spl.S.C.No.28 of 2025 on the file of the District and Sessions Court at Tirupattur in connection with Crime No.02 of 2025 on the file of the respondent.

2. The case of the prosecution is that the petitioner had committed penetrative sexual assault against the victim girl aged about 10 years. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that, petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

3. The learned Government Advocate (Crl. Side) reiterated the prosecution case and opposed for grant of bail to the petitioner. He also produced the statement of the victim girl under Section 183 of BNSS, wherein the victim girl had categorically stated that the petitioner had committed penetrative sexual assault against her.

4. Considering the age of the victim and the charges against the petitioner appears to be very serious and heinous, this Court is not inclined to grant bail to the petitioner.
