The respondent initiated proceedings in H.M.O.P.No. 07 of 2016 before the Sub Court, Harur, praying for a decree of restitution of conjugal rights. The petitioner on appearance before the trial Court filed this petition for transfer.
2. None appears on behalf of the petitioner. Heard the learned counsel for the respondent.
3. The petitioner is a permanent resident of Krishnagiri. According to the petitioner, it would not be possible for her to travel to Harur for the purpose of defending the proceedings in H.M.O.P.No. 07 of 2016 pending before the Sub Court, Harur. There is nothing on record to disbelieve the case pleaded by the petitioner. I am therefore of the view that the matter requires transfer.

In the result, the proceedings in H.M.O.P.No. 07 of 2016 is withdrawn from the file of Sub Court, Harur and is transferred to the file of Sub Court, Krishnagiri, for disposal on merits.

5. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs.
