ORDER
This Criminal Original Petition has been filed seeking to set aside the order dated 8-6-2026 made in Crl.M.P.No.250 of 2026 and consequently, modify the condition directing the petitioner to execute a bond for a sum of Rs.20,000/- with two sureties.
2. The case of the prosecution is that the petitioner and the victim were known to each other and shared a friendly relationship. Subsequently, the petitioner allegedly threatened the victim that he would upload her private photos. Hence, the present complaint has been lodged.
3. The petitioner, who has been arrayed as accused in Crime No.5 of 2026, was arrested on 10.03.2026. Thereafter, the petitioner filed a bail application in Crl.MP.No.196 of 2026. The Principal Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore by order dated 18.05.2026, taking note of the fact that the petitioner had been in custody for more than 70 days, granted bail subject to certain conditions, one of which was that the petitioner should execute a bond for a sum of Rs.20,000/- with two sureties. Thereafter, the petitioner filed a modification of the said condition in Crl.M.P.No.250 of 2026. The Principal Special Judge, by order dated 08.06.2026, dismissed the said petition. Against which, the present petition has been filed.
4. The learned counsel for the petitioner submitted that it was the victim who had voluntarily sent the photographs to the petitioner. Later, a false case has been foisted against the petitioner as though he threatened to upload the photos. Though the bail was granted as early as on 18.05.2026, the petitioner was unable to avail the benefit of the bail order due to the onerous condition requiring him to execute a bond for Rs.20,000/- with two sureties.
5. The learned Government Advocate (Crl. Side) submitted that the petitioner is aged about 19 years and that the investigation was completed and final report has been filed. The petitioner's mobile phone has been seized and sent for forensic examination and that the forensic report is still awaited.
6. Heard the learned counsel appearing on either side and perused the materials available on record.
7. It is seen that the petitioner is a young man aged about 19 years and is residing with his parents. The materials available on record indicate that he does not possess sufficient financial means to comply with the condition requiring execution of a bond for Rs.20,000/- with two sureties. It is also seen that though the bail was granted as early as on 18.05.2026, due to the said condition he has not been able to secure his release.
8. In view of the above circumstances, this court is inclined to modify the conditions imposed while granting bail. Accordingly, conditions "a" and "c" in the operative portion of the order dated 18.05.2026 passed in Crl.MP.No.196 of 2026, are modified as follows:
a) The petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties, each for a like sum to the satisfaction of the learned Principal Special Judge and shall produce his residential proof;
c) The petitioner shall report before before the Principal Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore, on all hearing dates with out fail.
The other conditions imposed in the order dated 18.05.2026 shall remain unaltered. Accordingly, this Criminal Original Petition is disposed of. 24-06-2026 Index: Yes/No Speaking/Non-speaking order PVS
