The Criminal Original Petition has been filed by the petitioner to quash the FIR in Crime No.295 of 2025 on the file of the first respondent police in so far as he petitioner is concerned. 1/5

The learned counsel for the petitioner submitted that based on the complaint given by the second respondent, the first respondent police registered a case against the petitioner and others in Crime No.295 of 2025 on 19.04.2025 as if, the petitioner and others, abused and attacked the defacto complainant. The contention of the petitioner is that, the petitioner is a minor and college student and also a sports person having received several accolades for Boxing and Archery and he never involved in the alleged offence. Further, there is no specific overt-act against the petitioner and due to political motive with his father, a false case has been foisted by the defacto complainant against the petitioner. Therefore, the FIR is liable to be quashed.
3. The learned Government Advocate (Crl. Side) appearing for the first respondent police submitted that there is a specific overt-act against the petitioner and therefore, the case has to be proceeded further for investigation.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) and also perused the materials available on record.
5. Since no adverse order is being passed against the second 2/5
respondent, notice to the second respondent is dispensed with.
6. A reading of the FIR shows prima facie allegations and specific overt-act against the petitioner.
7. Therefore, the respondent police is directed to complete the investigation within a period of two months from the date of receipt of a copy of this order.
8. However, since the petitioner is a college student, the respondent police is directed not to harass the petitioner under the guise of investigation and the petitioner is directed to co-operate for the investigation.
9. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed.
