The petitioner herein has sought for suspension of sentence before the lower appellate Court pending disposal of Crl.A.No.209 of 2024 against the judgment of the XXV Metropolitan Magistrate, Egmore, Chennai, passed in S.T.C.No.279 of 2023 for an offence under Section 138 of Negotiable Instruments Act. The said application for suspension of sentence in Crl.M.P.No.8456 of 2024 was dismissed by the Principal Sessions Judge on 15.03.2024, stating that the period of suspension of sentence expired.

Being aggrieved, the petitioner herein has filed Crl.O.P.No.8093 of 2024. Wherein, the petitioner has come forward to deposit 20% of the compensation amount i.e., Rs.4,60,000/- as a pre condition for suspension of sentence.

Taking note of the fact that the petitioner purchased a demand draft for Rs.4,60,000/- in favour of the Chief Metropolitan Magistrate, Egmore, this Court suspended the sentence with direction to deposit the demand draft before the https://www.mhc.tn.gov.in/judis

rpl XXV Metropolitan Magistrate, Egmore in the account of S.T.C.No.279 of 2023 within a period of 7 days. The petitioner was not able to deposit the demand draft in time, since the certified copy of the order dated 08.04.2024 passed by this Court was made ready subsequently. Hence the present petition is filed for extension of time.

The learned counsel for the petitioner has revalidated the earlier demand draft and produced before this Court for perusal. Since the petitioner has complied the order by purchasing the demand draft for Rs.4,60,000/- but could not deposit in time for the reason stated, time to deposit is extended.
