This writ petition has been filed for a direction to the Tahsildar, Ariyalur Taluk & District to process the subdivision Patta transfer application submitted by the petitioner vide Can No.133170125306749 and Application No.2023/0105/17/130744 dated 16.10.2023 for sub-division of properties and issuance of separate patta in existing Joint Patta No.2209 in petitioner's name, based on the registered sale deed Document No.1896/2012 dated 17.08.2012 registered in the name of petitioner for properties comprised in Survey Nos.137/26A measuring an extent of 0.00.75 Areas out of 0.01.5 Ares and Survey No.137/26B measuring an extent of 0.01.00 Ares out of 0.02.0 Ares Page 2/6
Taluk & district, within a stipulated time.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4 and perused the entire materials available on record.
3. It is the case of the writ petitioner that the petitioner purchased some extent of property vide registered sale deed dated 17.08.2012, registered as Document No.1896/2012. He has made an on-line application on 16.10.2023 for sub-division and separate patta for the properties covered under the above sale deed. He has also paid necessary charges for sub-division of survey and for separate patta.
4. Considering the limited relief sought for in this writ petition, the third respondent is directed to consider the application of the petitioner dated 16.10.2023 and pass appropriate orders on the petitioner's application for survey, sub-division and issuance of separate patta for the land situated in Survey Nos.137/26A measuring an extent of 0.00.75 Areas out of 0.01.5 Ares Page 3/6
and Survey No.137/26B measuring an extent of 0.01.00 Ares out of 0.02.0 Ares Taluk & district, on merits and in accordance with law, after giving notice to the neighbouring land owners and any other interested persons. Such exercise shall be completed within a period of two months from the date of receipt of copy of this order.
5. Accordingly, the writ petition is disposed of. However, there is no order as to costs.
