ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.05.2025, for the offence punishable under Sections 305(a), 62 of Page No.1 of 4

BNS r/w 3 of TNPPDL Act in connection with Crime No.187 of 2025, registered on the file of the respondent, seeks bail.

2. The contention of the learned counsel for the petitioner is that the petitioner has been falsely implicated in the above case. It is alleged that the petitioner and two others had tampered the ATM machine and committed theft.

3. Learned Additional Public Prosecutor appearing for the respondent police strongly opposed for grant of bail to the petitioner stating that the petitioner is from the State of Uttar Pradesh and he along two others had tampered the ATM machine and also devised a plan that whenever money is withdrawn, money does not come out to the customer, but get itself struck in the ATM machine. After certain swipes, they open the ATM machine and collect the money. Thereby, committed theft in the ATM machine and hence, public money is lost. He further submitted that since the petitioner hails from Uttar Pradesh and now, the investigation has been completed, if he is let out on bail, the trial before the learned XVIII Metropolitan Magistrate Court, Saidapet, Chennai, would get stalled and there are only seven witnesses. 4. In view of the above submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. The Trial Court is directed to take the charge sheet on file and complete the trial without any further delay within a period of six (6) months from the date of receipt of a copy of this order. The Trial Court is reminded that the petitioner as well as the other accused in this case are in prison, hence, priority may be given to complete the trial within the time stipulated by this Court.
