PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the 2nd respondent police to produce the body of the detenue, namely, Lathikasri (17) , D/o. Ramaraj before this Hon'ble Court and set her at liberty.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Habeas Corpus Petition has been instituted to direct the 2nd respondent to produce the body of the detenue, namely, Lathikashree, D/o.Rmaraj, aged about 17 years.

2. Initially, a criminal case was registered in Crime No.141 of 2024 under Girl missing and subsequently, it was altered under Section 5(L) r/w. 6 of the POCSO Act. The detenue was secured by the police on 27.07.2024 and produced before the Judicial Magistrate, Senthamangalam. The detenue expressed her consent to stay at Government Home.

3. Accordingly, the detenue at present stays at Government Home. Therefore, question of considering the relief, as such, sought for in the present Habeas Corpus Petition would not arise at all. Consequently, Habeas Corpus Petition is dismissed.
