PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st and 2nd respondents herein to take necessary actions against the 3rd and 4th respondents for their illegal operations at Kovil Vazhi Bus Stand without valid permit or timings, 1/6

The petitioner seeks direction to respondents 1 and 2 to take necessary action against the respondents 3 and 4 for the illegal operations at Kovil Vazhi Bus stand without valid permit or timings.
2. The petitioner is a stage carriage operator plying his vehicle from Tiruppur bus stand to Koduvai via Kovil Vazhi Bus stand. The respondents 3 and 4 are permitted to operate in the very same route on different timings. However, the respondents 3 and 4 failed to adhere to the time slots alloted to them. Therefore, the collection of the petitioner gets affected. In this regard, the petitioner submitted a representation to the 1st and 2nd respondents on 12.06.2023 requesting them to take necessary action against the 3rd and 4th respondents for their failure to adhere to the time slots. The said representation has not been considered so far. 2/6
3. Mr.N.Naveen Kumar, learned Government Advocate takes notice for the 1st and 2nd respondents.

In view of the limited prayer made by the petitioner, without expressing any opinion on the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the 1st respondent to consider the representation of the petitioner dated 12.06.2023 and pass final orders on merits and in accordance with law after issuing notice to 3rd and 4th respondents within a period of eight weeks from the date of receipt of a copy of this order.
