Respondents Prayer :- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a writ of Certiorarified Mandamus to call for the records relating to the impunged Orders of Recovery passed by the first respondent in his proceedings in Rc.No.QC3/95593/07 dated 24.05.2008 confirming the orders of recovery passed by the second respondent in his proceedings in Na.Ka.No.05729/06/T.1 dated 27.09.2007 and quash the same and consequently direct the respondents to return the recovered amount to the petitioner with interest.

Mr.K.Prem Kumar, learned counsel appearing for the petitioner contended that nothing survives in this petition and the petition becomes infructuous. Learned counsel for the petitioner has also made an endorsement for withdrawing the petition as infructuous.
2. Based on the submission and endorsement made, the Writ Petition is dismissed as withdrawn. Consequently connected miscellaneous petition is closed.
