The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 294(b), 506(i) and 509 of IPC r/w Sections 67, 67A of Information Technology Act, 2000 in Crime No.155 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No.155 of 2023 for the offences under Sections 294(b), 506(i) and 509 of IPC r/w Sections 67, 67A of Information Technology Act, 2000, with a political motive. Infact, defacto complainant and his friends had posted a post, showing the petitioner among badly dressed women and projected the petitioner in a bad lime light. Petitioner is innocent. Apprehending arrest at the hands of the respondent, this petition is filed.

3. Learned Government Advocate (Criminal side), opposes on the ground that, defacto complainant and his friend's family took a

photograph and that photograph was shared by the defacto complainant's brother Srinivasan in his twitter handle. Using that photograph and replacing the faces with emojis, petitioner had posted with abusive language in the twitter handle called 'Voice of Savakku'. He further submitted that, investigation is pending in this case. Thus, he prays for dismissal of this petition.

4. Considered the submissions and perused the records.

5. It is seen from the first information report allegations and twitter posts produced by the learned Government Advocate (Criminal side) that, the post was posted in the twitter handle called 'Voice of Savukku'. According to the prosecution, the posts were posted by the petitioner.

6. In the nature of the allegations made against the petitioner and that prima facie the posts appear to be bad and that investigation in

this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 28.07.2023 gd
