ORDER
The petitioner apprehends arrest for the alleged offence under Sections 303(2), 232(a) of BNS, 2023 r/w 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.227 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and other accused illegally transported one unit of gravel soil using a lorry and JCB without obtaining valid permission. Hence the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and has no connection whatsoever with the alleged offence and has been falsely implicated in the present case. Therefore, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) would oppose the application on the ground that the petitioner has one previous case of similar nature. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. This Court is of the view that the petitioner is having one previous case, which clearly demonstrates that he is a person who has misused the liberty granted to him earlier. Considering the antecedents of the petitioner and the nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner.
