This Criminal Original Petition has been filed challenging the order passed by the Court below in Crl.M.P.No.16920 of 2023 dated 18.07.2023 1/4

refusing to extend the time for the petitioners to surrender and to produce sureties.

2. Heard Mr.V.P.Raju, learned counsel for petitioners and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondent.

3. The petitioners filed an anticipatory bail petition before the Court below and the Court below granted anticipatory bail in Crl.M.P.No.14373 of 2023 by order dated 27.06.2023 by imposing certain conditions. One of the condition was that the petitioners should surrender and produce sureties within a period of fifteen days from the date of the order.

4. There was some difficulty for the petitioners to surrender within the time prescribed by the Court and hence, an application was filed before the Court below seeking for extension of time. This application was dismissed by the Court below by order dated 18.07.2023. Aggrieved by the same, the present petition has been filed before this Court.

5. When the matter was taken up for hearing, it was brought to the notice of this Court that the petitioners filed yet another anticipatory bail petition before the Court below in Crl.M.P.No.17524 of 2023. This petition came to be dismissed by the Court below by order dated 25.07.2023.

6. In the light of the above development, no further orders can be passed in this petition since the filing of the subsequent anticipatory bail virtually effaces the effect of the earlier order passed in Crl.M.P.No.14373 of 2023. In view of the same, it is left open to the petitioners to move an anticipatory bail petition before this Court and work out their remedy. Except giving this clarity, no further orders can be passed in this petition.
