Prayer: Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the respondents 1 and 2 or those acting under them not harass the petitioners with regard to any complaint with reference to the property at No.5/2, K.K.Road, Plot No.169, Kaveri Rangan Nagar, Saligramam, Chennai-600 093, which is the subject matter of C.S.No.75 of 2024 and O.P.No.456 of 2012, in the civil dispute pending between the petitioners and the respondents 3 to 6, except as per the procedure established by law or such matters as may be incidental or ancilliary thereto.

O R D E R

Civil dispute regarding the property in which the 1st petitioners deceased husband has a share. In this connection, already civil suit before the High Court is pending in C.S.No.75 of 2024. While so, the petition is filed seeking protection from police harassment.

2. Alleging that on the complaint given by Siva Subramaniam, the brother-in-law of the petitioner, police is harassing her . 2/5

3. Learned Government Advocate (Crl.Side) submits that the complaint was given by one Siva Subramaniam registered as CSR.No.388 of 2024 . After enquiry, the parties are directed to resort legal remedy through Civil Court and the complaint been quashed. He further submits that the police is not harassing the petitioner and her allegation is absolutely false.

4. Considering the materials produced, this Court finds that civil dispute regarding the property already been seized by the High Court in C.S.No.75 of 2024 and the police had already enquired the matter and closed it as civil dispute. There is no cause to entertain this petition. Hence, this Criminal Original Petition is closed. 13.08.2024 Vv To
