Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the Respondent to measure the land comprised in S.No.51/17 (Old S.No.51/2) measuring an extent of 130 Square Meters, in Sonarahalli Village, Pochampalli Taluk, Krishnagiri District and earmark the boundaries by considering the online Challan No.2023020205619 dated 02.02.2023.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus to direct the respondents to measure the land comprised in S.No.51/17 (Old S.No.51/2) measuring an extent of 130 Square Meters, in Sonarahalli Village, Pochampalli Taluk, Krishnagiri District and earmark the boundaries by considering the online Challan No.2023020205619 dated 02.02.2023.

3. It is submitted by the learned counsel for the petitioner that the subject property originally belonged to petitioner's husband Late Mr.Rajendran. The petitioner's husband died on 25.01.2019 intestate leaving behind the petitioner and two children as his legal heirs. 2/5

4. It is further submitted by the learned counsel for the petitioner that after the demise of petitioner's husband, petitioner is in possession of the subject property. It is also submitted that Grama Natham Patta has been issued in respect of the subject property and the said Patta stands in the name of the petitioner's deceased husband. Under these circumstances, the petitioner submitted an Online Application on 02.02.2023 and also, she paid necessary fees to measure the subject property. However, no action has been taken by the respondents. Hence, this writ petition.

5. The learned Government Advocate appearing for the respondents submitted that the respondents would consider the petitioner's Online Application dated 02.02.2023 and measure the subject property and place boundary stones therein, within a time frame to be fixed by this Court.

6. The above submission made by the learned Government Advocate for the respondents has been fairly conceded by the learned counsel for the petitioner.

In view thereof, the writ petition stands disposed of with the direction to the respondents to measure the subject property and place boundary stones therein, within a period of 8 weeks from the date of uploading of the web copy of this order, after giving prior notice to the petitioner, adjacent land owners and other interested parties including rival claimants if any. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondents to consider the matter on its own merits and in accordance with law. No costs.
