ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379 of I.P.C and section 3(1) of Prevention of Damage to Public Property Act, 1984, in Crime No.509 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was involved in illegal sand theft. Hence, the law enforcing agency registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submits that the petitioner did not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submits that the the petitioner was involved in illegal sand theft. He further submits that there are five previous cases pending as against the petitioner. Hence, he vehemently opposed grant of Anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, the petitioner has involved in illegal sand theft and also considering that there are five previous cases similar in nature, this court is not inclined to grant anticipatory bail to the petitioner.
