Learned Counsel for the Petitioner submits that the petition has been filed to condone the delay of 458 days in filing the Appeal in C.M.A.S.R.No.91263 of 2025.
2. Learned Counsel for the Petitioner also submits that the Respondent-1 remained exparte before the trial Court. Therefore, she seeks to dispense with notice to Respondent-1.
3. Learned Counsel for the Respondent2/Insurance, Mr.J.Chandran present in Court undertakes to file Vakalat for Respondent-2.
He has no objection in allowing the petition provided the interest on the award amount to be waived for the period of delay of 458 days.
4. Accordingly, the petition in C.M.P.No.14395 of 2025 is allowed on condition that the Appellant is not entitled to claim interest for the period of delay of 458 days.
5. Registry is directed to number the Appeal if it is otherwise in order and to print the name of Mr.J.Chandran as learned Counsel for Respondent-2, if Vakalat is filed and found proper.
