Respondent(s) PRAYER Directing the respondent to pay the petitioner interest at the rate of 18 percent per annum, for the period of delay from 01.06.2023 to 09.03.2025, in paying the amounts paid towards his terminal benefits namely EPF Employees Contribution, Gratuity and Encashment of Leaves, Commutation within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

ORDER

The present writ petition has been filed to direct the respondents Transport Corporation to settle the interest for the belated payment of retirement benefits such as Gratuity, Commutation of Pension, Provident Fund and other retirement benefits payable to the petitioner with interest.

2. The learned counsel for the petitioner would submit that the petitioner was employed in the respondents-Transport Corporation. After attaining the age of superannuation, the petitioner was retired from service as a SPG.DR L5-ST Car Driver. However, his retirement benefits were paid belatedly without paying any interest. It is the submission of the petitioner that he is entitled for the interest for the belated payment. In this regard, the petitioner submitted a representation dated 24.03.2025 to the respondents Transport Corporation and such representation is yet to be considered by the respondents

At this juncture, the learned Standing Counsel appearing on behalf of the respondents Transport Corporation would fairly concede that in view of the similar orders passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

In view of the above submission made by the learned Standing Counsel for the respondent, this Court deems it appropriate to direct the respondents to pay the interest at the rate of 6% per annum for the belated payment of terminal benefits, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above directions, these Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 28-07-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
