ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 430, 379 IPC r/w 21(5) of Mines and Minerals (Development & Regulation) Act 1957, in Crime No.509 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were involved in illegal transportation of 3 units of river sand by using lorry without valid licence. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner did not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submits that the the petitioner with other accused were involved in illegal transportation of 3 units of river sand in a lorry. Hence, he vehemently opposed for grant of Anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, the petitioner has involved in illegal mining of river sand by using lorry thus deteriorating ecology, this court is not inclined to grant anticipatory bail to the petitioner.
