..Respondent PRAYER Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to consider and process the petitioner's applications bearing No.1870, dated 29.05.2026 and consequently issue Caste Certificates certifying the petitioner's children, namely, Pranav P.Kumar and VidhyaSri.P as belonging to Hindu Adi-Dravidar based on the petitioner's caste status issued under the Constitution (Puducherry) schedule caste order 1964, within a time frame fixed by this Hon'ble Court. ORDER
(Order of the Court was made by Dr.G.Jayachandran, J.) The Writ Petitioner, M.Nathiya, claims that she belongs Hindu AdiDravidar Community, which is recognized as a Scheduled Caste under Sl.No.02 of the Constitution (Puducherry) Schedule Caste order 1964. She was born in Puducherry on 26.03.1981 and subsequently, she got married to one Pradeep @ Krishnakumar, a native of Tamil Nadu. After their marriage, they permanently settled in Puducherry.

The petitioner's son Pranav B.Kumar, was born on 19.01.2009 at Government Maternity Hospital, Puducherry and her daughter Vidhya Sri, B. was born on 10.12.2011 at Ashvini Maternity Hospital, Puducherry. Whileso, based on her caste status by birth and origin, the petitioner submitted applications seeking issuance of Scheduled Caste Certificates to her children. The said applications, bearing Application No.1870, dated 29.05.2026 and Application No.1905, dated 01.06.2026 are pending consideration before the respondent.
3. According to the petitioner, Schedule Caste Certificates ought to be issued to her children based on the mother's origin and community status, dehors of the Community or Origin of the father. However, no decision has been
taken by the authorities on her applications. The inaction on the part of the respondents is causing serious prejudice to the educational prospects of her children.
4. The learned Additional Government Pleader representing for Puducherry Government submitted that the applications made by the petitioner are under consideration, in the light of the Presidential Order dated 05.03.1964; the subsequent Circulars and Official Memorandums issued from time to time. Based on the Judicial Pronouncements rendered sofar, necessary decision will be taken on her applications in accordance with law.

Recording the submissions made by the learned Additional Government Pleader, this Writ Petition is disposed of with a direction to the respondent to consider the applications of the petitioner dated 29.05.2026 and 01.06.2026 and pass appropriate orders thereon, on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order. No costs.
