A.S.No.468 of 2023 P.T.ASHA.J., This matter is posted today (19.03.2024) under the caption for being mentioned.

2. In paragraph 33 of the judgment dated 28.02.2024, it has been stated that there will be no order as to costs. Since the suit is one for recovery of money and the suit has now been decreed, the plaintiff is entitled to costs. Therefore, the judgment stating no costs has been passed by an oversight and the same is clarified as below.

"Therefore, the First Appeal is allowed with costs throughout.

The judgment and decree of the Trial Court, namely, The III Additional District Court, Kallakurichi is set aside. Consequently, the connected miscellaneous petition is closed".

3. In all other aspects, the earlier order dated 28.02.2024 shall remain unaltered.

4. The Registry is directed to issue a fresh corrected copy of the judgment to the parties.
