Prayer : Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of habeas corpus, directing the respondents to produce the petitioner's daughter Ms.Pavithra D/o.Annamalai, aged about 16 years before this Court and set her at liberty forthwith.

O R D E R

(delivered by K.K. SASIDHARAN,J.) This Habeas Corpus Petition is taken up for hearing today, pursuant to the representation made by the learned Additional Public Prosecutor, to the effect that the Police secured the detenue and she is being produced before the Court today.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State.

3. We have enquired the detenue by name Ms.Pavithra. According to the detenue, she left the home on account of certain difference of opinion. The detenue is now prepared to go with the petitioner, who is none other than her biological father. The petitioner, who appeared before us, submitted that he is prepared to take the detenue.

4. The minor was put in the Child Welfare Committee, Tiruvallur, by police, and she is produced from the said home today.

5. The custody of the detenue viz., Ms.Pavithra is handed over to the petitioner.

6. We direct the President, Child Welfare Committee, Tiruvallur, to make an entry with regard to the handing over of the custody of the minor viz. Pavithra to the petitioner.

7. The Habeas Corpus Petition is closed with the above observation.
