ORDER : The Court Made the following order :- The petitioners seek anticipatory bail in Crime No.4 of 2018 registered by the respondent police for the offence punishable under Sections 363 and 366 of IPC.
2. The case of the prosecution as per the de-facto complainant one Saravanan is that on 11.06.2018, his minor daughter Shalini, aged 17 years was found missing from his residence. During enquiry, it came to light that the petitioner's son Veeramani, who had love affair with the girl, had kidnapped the minor girl.
3. The learned counsel for the petitioners would submit that the petitioners are the parents of Veeramani (A1) in this case and that they came to understand that the first accused had eloped with the daughter of the defacto complainant, who is in verge of attaining majority. He would submit that the victim girl has been secured and handed over to the police, who have in turn to produced her before the Court and recorded the statement under Section 164 Cr.P.C and that she is now kept in juvenile home on 11.07.2018.
4. The learned Additional Public Prosecutor would submit that the first accused in this case, who is the son of the petitioners herein, kidnapped the victim girl aged 17 years. He would submit that the petitioners have not been arrayed as accused in this case.
5. Taking into consideration the facts of the case and the submission made by the learned Additional Public Prosecutor that the petitioners are not the accused in this case and there is no apprehension of arrest. Hence, this Criminal Original Petition is closed.
