O R D E R

This Criminal Original Petition has been filed under Section 482 of Code of Criminal Procedure, 1973 praying to direct the respondent to alter the charges in Crime No.59 of 2016, investigate the same and further direct the respondent to file a final report.

2. Heard both sides.

3. Learned counsel for the petitioner submits that the case has been originally registered in Crime No.59 of 2016 for offences under Section 279 and 337 IPC on 27.03.2016. Subsequently, the victim in the accident passed away on 11.04.2016. Still the Police has not altered the Section and therefore, the present petition has been filed to direct the Police to alter the charges.

4. Learned Additional Public Prosecutor submits that he would instruct the Police appropriately.

5. Considering the death of the victim and the circumstances of this case, this Court directs the respondentPolice to alter the Section and proceed with the investigation expeditiously.

With the above direction, this Criminal Original Petition is disposed of.
