R.PONGIAPPAN, J., This application has been filed under Order XIV Rule 8 of Original Side Rules read with Section 12 of the Guardian and Wards Act, seeking the relief to direct the respondent to grant interim custody of the minor child R.M.Nithin, born on 19.01.2012, now aged about 8 years to the applicant / petitioner forthwith pending disposal of the above Original Petition.

2. Heard the learned counsel appearing for the applicant and learned counsel appearing for the respondent.

3. It is agreed by the learned counsel appearing on either side that as per the existing arrangement, the applicant herein is permitted to see his minor child in one Sunday of every month.

4. In the said circumstances, this application has been filed for the relief of direction, directing the respondent to grant interim custody of 1/3

the minor child, till the disposal of the Original Petition. During the course of arguments, both the learned counsels are fairly agreed for the following proposal;

"The applicant is permitted to take the minor child from 10.00a.m. to 5.00p.m. on alternate Sundays. Further, the applicant himself make arrangement for picking up the minor child from the house of the respondent and for dropping him."
