O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing respondents 2 & 3 to remove the name of Jeeva from Patta No.2544 in respect of subject property comprised in Survey No.587/1A9A1 now Survey No.587/1A9A1A, Pallikaranai Taluk, Sholinganallur Taluk, Chennai District in terms of the order passed in Na.Ka.No.048/2021/A1 dated 21.05.2021 by the first respondent.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

3. The case of the petitioner is that the property comprised in Survey No.587/1, then Survey No.587/1A9A1 measuring an extent of 5177 sq.ft situated at Pallikaranai Village, Sholinganallur Taluk, Chennai District originally owned by petitioner's father, Raman, who executed a Will on

19.12.1983 bequeathing the said property in favour of petitioner. Her father died on 03.03.2003 and mother died on 19.07.2011. After the demise of petitioner's father and mother, petitioner acquired title to the said property and has been in continuous possession and enjoyment of the same in terms of the said Will. Thereafter, petitioner settled a portion of the property measuring an extent of 4033 sq.ft in favour of her husband vide settlement deed dated 12.01.2015 registered as Document No.289 of 2015 on the file of Sub Registrar, Chennai, South Joint-1. When petitioner's husband approached first respondent for mutation of patta in respect of settled portion of land, it was found that the patta has been issued wrongly in the name of one Mrs.Jeeva in respect of Survey No.587/1A9A1.

Therefore, petitioner made a representation for removal of name of the said Jeeva before first respondent and the first respondent after conducting an enquiry, removed the name and transferred the patta in respect of property measuring an extent of 4033 sq.ft in favour of her husband. Insofar as remaining extent of 1141 sq.ft is concerned, the name of Jeeva still reflects in the revenue records.

After conducting enquiry, first respondent passed the impugned order dated 21.05.2021 directing respondents 2 & 3 to remove the name of Jeeva in all revenue records in respect of subject property. However, the said order has not been implemented. Hence, the present writ petition has been filed.

4. Learned counsel appearing for petitioner submits that it would suffice, if this Court issues a direction to respondents 2 and 3 to implement the order dated 21.05.2021 passed by first respondent and pass appropriate orders, within a time frame that may be fixed by this Court.

5. Learned Special Government Pleader appearing for respondents has no serious objection for such an order being passed by this Court.

6. Considering the limited request made by learned counsel for petitioner, this Court directs respondents 2 and 3 to implement the order dated 21.05.2021 passed by first respondent with regard to removal of wrong

entries made in the revenue records within a period of twelve weeks from the date of uploading of web copy without waiting for receipt of certified copy after issuing notice to petitioner, present pattadhar, i.e., Jeeva and other interested parties including rival claimants, if any and affording a reasonable opportunity of hearing.
