The present Miscellaneous petition has been filed seeking to modify the order of this Court dated 16.03.2023 made in W.P.No.8062 of 2023, which was subsequently corrected, vide order dated 08.06.2023 by directing the insurance company, ICICI Lombard, General Insurance Company Limited, ICICI Lombard House, Veer Savarkar Marg, Near Siddhi Vinayak Temple, Prabhadevi, Mumbai400 025 instead of the 4th respondent therein.

2. However, when this Court expressed its opinion that no direction can be issued to the Insurance company, ICICI Lombard, General Insurance Company Limited, since it is not the party to the main Writ petition, the learned Additional Solicitor General appearing for the petitioners herein submitted that, it would suffice, if this Court issues direction to the 3rd respondent instead of the 4th respondent in the main Writ petition.

3. In view of the above, this Court is inclined to modify paragraph 6 of the order dated 16.03.2023 which was subsequently corrected vide order dated 08.06.2023 and para no.6 of the order shall read as follows: 1/2 https://www.mhc.tn.gov.in/judis

skt "6. Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, the 3rd respondent is directed to consider the representation of the petitioners' dated 01.02.2023 and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order."

4. All the other observations and conditions made in the earlier order dated 16.03.2023 which was subsequently corrected vide order dated 08.06.2023 shall remain intact except for the above said correction.

5. Registry is directed to carry out the necessary correction as aforesaid in the order dated 16.03.2023 which was subsequently corrected vide order dated 08.06.2023 and issue fresh copy of the order to the learned counsel for the parties.
