Criminal Original Petition filed under Section 407 of the Criminal Procedure Code to withdraw the case in C.C.No.193 of 2008 , from the file of the Judicial Magistrate No.I, Tiruppattur, and to transfer the same to any of the Metropolitan Magistrate Court, Chennai.

O R D E R

The learned counsel appearing for the petitioner submitted that the petitioner/accused may be permitted to take all defences that are available to him before the Trial Court, and with this observation, this Petition may be disposed of.

Taking into consideration of the above submission, and the fact that the case has been pending from the year 2008, this Criminal Original Petition is dismissed and liberty is given to the petitioner to take all defences that are available to him during trial, and the Trial Court is directed to dispose of the case in C.C.No.193 of 2008, within a period of four months from the date of receipt of a copy of this order. Consequently, connected M.P. is closed.
