The petitioner namely M.Sasikumar, who was arrested and remanded to judicial custody on 15.05.2023 for the offences punishable under Sections 366, 342 IPC and r/w 5(1) and 6 of POCSO Act Crime No.137 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No. 137 of 2023 for the offences under Sections 366, 342 IPC and r/w 5(1) and 6 of POCSO Act. Petitioner is in judicial custody from 15.05.2023. He further submitted that, petitioner and victim girl fell in love with each other. Petitioner is innocent. Thus, he prays for grant of bail.

3. The learned Government Advocate (Crl. Side) opposes this petition, on the ground that, victim girl is only 14 years old and petitioner is 26 years old. Petitioner is already married. Petitioner lured the innocent and immature girl of 14 years and had sexual relationship with her. The investigation in this case is not completed. Therefore, he prays for dismissal of this bail petition. 1/3

4. Considered the submissions and perused the records.

5. It is seen from the Statement recorded under Section 164 Cr.P.C of the victim girl that, petitioner told her that, he was in love with her and took her to Vellimalai temple and married her. They visited Bangalore and stayed in a hotel. Thereafter, police party apprehended them.

6. Considering the nature and seriousness of the allegations and that petitioner is 26 years old married man and victim girl is only 14 years old and that investigation in this case is not completed, this Court is not inclined to release the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed.
