O R D E R

The petitioner has filed this transfer petition to transfer the proceedings in H.M.O.P.No.106 of 2016 pending on the file of Additional Family Court, Coimbatore to the file of Principal Subordinate Court, Mayiladuthurai.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing on behalf of the respondent.

3. During the currency of this transfer petition, the Trial Court passed an ex-parte decree in H.M.O.P.No.106 of 2016. In view of the subsequent events, nothing survives for adjudication.

4. The learned counsel appearing for the petitioner submits that the petitioner would move the Trial Court to set aside the ex-parte decree.

5.It is open to the petitioner to file a fresh petition for transfer,after restoration of the proceedings in HMOP.No.106 of 2016.

The transfer petition is dismissed with liberty as indicated above. No costs. Consequently, connected miscellaneous petition is closed.
