This application has been filed by the Applicant / Decree holder under Order XXI Rule 41(2) of Civil Procedure Code, directing the Judgment debtor to disclose his assets, bank account details etc., by an affidavit.

2. This Court by order dated 02.01.2020, allowed the application and directed the judgment debtor to disclose his assets, bank account details and other relevant documents. Since the respondent failed to appear before the learned Master, the matter was posted before this Court for "orders". Thereafter, by order dated 14.02.2023, this Court extended the time for examination of the respondent and the matter was directed to be listed before the learned Additional Master -I on 28.02.2023. The matter has been listed before the learned Additional Master -I on 28.02.2023, 02.03.2023, 03.03.2023 and 09.03.2023. Since there was no representation for the respondent before the learned Additional Master -I, the matter was directed to be posted before this Court.

3. When the matter was listed before this Court on 21.04.2023, there was no representation for the respondent. Even today (07.06.2023), when the matter came up for hearing, the learned counsel for the petitioner is present and there is no representation for the respondent.

4. It is informed that the learned counsel on record for the respondent Mr.K.Rajasekaran has passed away. In such circumstances, in order to give an opportunity to the respondent, this Court directs the learned counsel for the petitioner to take private notice to the respondent, returnable by 21.06.2023.

5. Post the matter on 21.06.2023.
