ORDER
(Heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 6
(4) of TNSC (RDCS) Order 1982 r/w Section 7(1) a (ii) of Essential Commodities Act 1955, in Crime.No.95 of 2020, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with other accused were found illegal possession of 28,000 kgs of PDS rice worth at Rs.1,58,200/-. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and is no way connected with the alleged offence. He would further submit that on the confession statement given by the co-accused, the petitioner has been falsely implicated in this case. 4.The learned Additional Public Prosecutor submits that the petitioner was found illegal possession of 28,000/- kgs of PDS rice. He would further submit that one similar previous case is pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the facts and circumstances of the case and also that the seized the PDS rice were of huge quantity and that the petitioner was involved in one previous case, this Court is not inclined to grant bail to the petitioner.
