ORDER

This writ petition has been filed for a direction, directing the respondents to survey the land measuring an extent of 23 grounds comprised in Survey No.676/1A1A1A2 and Survey No.679/1A1B and also issue a survey sketch.

It is the case of the writ petitioner that the petitioner had already given an application to survey the land to the Tahsildar, pursuant to such application, a notice was also issued by the Tahsildar on 07.02.2024 in Na.Ka.No.106 of 2024. In the meanwhile, the petitioner has filed a writ petition in W.P.No.7381 of 2024 for a direction to the respondents therein to initiate action against the trespassers in order to retrieve the subject property herein. This Court, by order dated 21.03.202, directed the respondents therein to complete the enquiry in the case. Now, the writ petitioner has also filed a contempt petition in Cont.P.No.1869 of 2024, this Court, by order dated 12.07.2024 directed the petitioner to present before the respondent on 17.07.2024 and the respondent shall take a decision and report before this Court on 26.07.2024 at 2.15 p.m.

3. Now, it is the contention of the learned counsel for the petitioner that the respondent herein is not co-operating and insisting for a specific order from this Court for conducting survey.

4. Heard both sides and perused the materials placed on record. By consent of both parties, this writ petition is taken up for final disposal in the admission stage itself.

Considering the nature of the orders already passed by this Court in directing the police officials to file a report on 26.07.2024, there shall be a direction to the respondent herein to conduct survey in respect of land for which application is already pending before the respondent dated 24.01.2024. The survey shall be conducted within this week and file a report before the concerned court in Cont.P.No.1869 of 2024, i.e., on 26.07.2024.

6. With the above directions, this writ petition stands disposed of. No costs.
